Hemos recibido información que el día 30 de Octubre de 2003, entre las 9:00 y 11:00 A. M. en casa de HEBERTH SUAREZ presidente de SINALTRAINAL Seccional Cali y trabajador de la empresa coca cola, se recibio una llamada telefonica que fue contestada por su señora esposa y un sujeto desconocido pregunto si ahí vivia el señor EBERTH SUAREZ, la compañera le pregunto que para que lo necesitba y el sujeto le responde "digale a ese sindicalista hijueputa que lo vamos a matar" y colgo.

Este hecho se presenta en momentos en que nos encontramos en conflicto la boral con la patronal coca cola por la forma ilegal como el día 9 de Septiembre de 2003 cerrró las embotelladoras de Valledupar, Cartagena, Monteria, Villavicencio, Cucuta, Barrancabermeja y Pereira, solicitando el despido de trabajadores y lanzando una campaña de presión y encierro a los trabajadores para obligarlos a renunciar a los contrato de trabajo a cambio de una indemnización económica e igualmente en forma unilateral anuncio el cambio de pago de salario a mensual y no quincenal como se venía haciendo.

Hace aproximadamente un mes a la sede de SINALTRAINAL ubicada en la calle 47 No 2N-23 de la ciudad de Cali, un hombre de nombre EDGAR ERNESTO DEL ALTO TRUJILLO que se identifico como agente especial enviado por el gobierno desde Bogotá y que trabajaba con el DAS, CTI y SIJIN, para hacer una investigación de seguridad al sindicato y manifesto que el podia ayudar a conseguir esquema de protección y recomendo a EBERTH SUAREZ que tuviera mucho cuidado en Pradera por que esa ciudad estaba llena de paramilitares.

Solicitamos de las autoridades se investigue esta amenaza, se de con los responsables matariales e intelectuales, se proteja la vida de nuestro compañero EBERTH SUAREZ y de todos los afiliados a SINALTRAINAL, se brinden las garantías para ejercer el derecho de asociación y la actividad sindical.

El día 22 de Octubre de 2003, siendo aproximadamente las 11:00 A.M., dos individuos llegaron a la casa de habitación de nuestro compañero JOSÉ ONOFRE ESQUIVEL LUNA integrante de la Junta Directiva de SINALTRAINAL Seccional Bugalagrande y Trabajador de Nestle, ubicada en la calle 2 sur No 9 37 Barrio Jose Antonio Galán del municipio de Bugalagrande- Valle del Cauca. Uno de los sujetos se quedo en la moto color blanco sin placa en la que llegaron y el otro alto de color moreno, pantalón Jeans azul y camisa azul claro entro al antejardín y pregunto a la esposa de nuestro compañero LUCELLY BOLAÑOS por JOSÉ ONOFRE ESQUIVEL LUNA, ella le pregunto de parte de quien? El sujeto respondio que de la fiscalía, LUCELLY le pidio que se identificara y no lo quizo hacer y dijo que despues regresaria buscarlo.

El lunes 28 de Octubre de 2003 el señor Gustavo Grisales jefe de recursos humanos de la Nestle en Bugalagrande, le comunica a JOSÉ ONOFRE ESQUIVEL que dos agentes investigadores de la SIPOL habían ido a la fabrica a buscarlo para que se entrevistara con ellos, el compañero Onofre llamo a la SIPOL y hablo con el señor JHON ALEXANDER BEDOYA y al preguntarle si habian enviado a agentes de esa institución a buscarlo y este le contesto que no habían estado buscandolo en casa.

Esto se presenta días despues de que nuestro compañero JOSÉ ONOFRE ESQUIVEL encontro en su vestier un comunicado de las Autodefenbsas donde lo declaran objetivo militar.

Solicitamos de las autoridades investigar los hechos y dar con los responsables de la amenaza, proteger la vida JOSÉ ONOFRE ESQUIVEL y de todos los

afiliados a SINALTRAINAL, protejer el derecho de asociación y brindar las garantías necesarias para realizar la actividad sindical.

New Death Threats - Letters from SINALTRAINAL

We have received information that between 9:00 am and 11:00am on 30 October 2003, a phone call was received at the home of HEBERTH SUAREZ President of the SINALTRAINAL Branch in Cali and a worker at Coca Cola. The phone was answered by Herbeth's wife. An unknown person asked if that was where Mr. EBERTH SUAREZ lived. Our comrade asked the caller why he was asking, and the caller told her "tell that son of a bitch trade unionist that we are going to kill him" and hung up.

This event took place at a time when we are involved in a labour conflict with Coca Cola because of the illegal way on 9 September 2003 it closed the bottling plants at Valledupar, Cartagena, Monteria, Villavicencio, Cucuta, Barrancabermeja and Pereira. The employer tried to sack workers and launched a campaign of pressure and confinement to oblige the workers to renounce their contract in exchange for economic compensation, while at the same time unilaterally announcing a change to monthly wage payments rather than the fortnightly wages it has been paying until now.

About one month ago a man by the name of EDGAR ERNESTO DEL ALTO TRUJILLO arrived at the SINALTRAINAL union office situated at No 2N-23 47th Street in Cali. He identified himself as a special agent sent by the government from Bogotá, [saying that] he was working with the DAS, CTI and SIJIN *, to investigate the security of the union and claimed that he could help obtain a security protection scheme. He recommended to EBERTH SUAREZ that he must take a lot of care in Pradera because that city was full of paramilitaries.

We demand of the authorities that this threat be investigated, that the material and intellectual authors of this threat are discovered, that the life of our comrade EBERTH SUAREZ and SINALTRAINAL members be protected , that guarantees are given for the right of association and trade union activity.

At about 11:00 am on 22 October 2003, two individuals arrived at the residence of our comrade JOSÉ ONOFRE ESQUIVEL LUNA, a member of the Executive Committee of the Bugalagrande Branch of SINALTRAINAL and a Nestle worker, situated at No 9-37, 2nd Street South in the Jose Antonio Galán district of Bugalagrande in Valle del Cauca department. One of the persons stayed on the motorcycle (white, without number plates), while the other (dark complexion, wearing blue jeans and a blue shirt) entered into the front garden, asking LUCELLY BOLAÑOS, wife of JOSÉ ONOFRE ESQUIVEL LUNA, for him. She asked who was seeking him? The person replied the fiscalia [prosecutors office]. LUCELLY asked the man to identify himself, but he did not want to do that, saying that he would return later for JOSÉ.

On Monday 28 October 2003 Mr. Gustavo Grisales, Head of human Resources at Nestle in Bugalagrande, informed JOSÉ ONOFRE ESQUIVEL that two investigating agents of SIPOL** had been to the factory seeking him so taht they could interview him. Comrade Onofre called SIPOL and spoke with Mr. JHON ALEXANDER BEDOYA, and on asking him if agents of that organisation had been sent to find him was told that they had no been searching for him at his home.

Then a few days later, our comrade JOSÉ ONOFRE ESQUIVEL found in his work clothes vestier a communique by from the autodefensas [paramilitary death squads] in which they declared him a military target..

We ask the authorities to investigate the events and ascertain those responsible for the death threat, protect the life of JOSÉ ONOFRE ESQUIVEL and all SINALTRAINAL members, protect the right of association and offer the necessary guarantees for trade union activity to be carried out.
