Nuevo atentado con explosivos a Sintraemcali : Indymedia Colombia

El sindicato de trabajadores de las empresas públicas de Cali, SINTRAEMCALI, La Asociación para la investigación y Acción Social NOMADESC y demás miembros de la Campaña PROHIBIDO OLVIDAR denuncian el nuevo atentado del que han sido victima los trabajadores de EMCALI EICE ESP afiliados a Sintraemcali, la Junta Directiva y los asesores del sindicato.

Hechos:

1. Siendo la 1:04 a.m. del día de hoy viernes 6 de febrero de 2004, fue colocado un explosivo en la puerta de entrada de la sede del Sindicato de las Empresas Municipales de Cali. SINTRAEMCALI, y donde se encuentra la sede de la Asociación para la Investigación y acción social NOMADESC, ONG, nacional de derechos Humanos.

2. El individuo que coloco el artefacto fue capturado por la policia y le incautaron un arma 9 m.m. y $ 120.00 efectivamente este hombre es el mismo que aparece en la grabación del circuito cerrado de televisión de Sintraemcali. Este hombre nunca nego los hechos por el contario dio la siguiente versión: "Que unos individuos de un taxi, lo habían amenazado de muerte si no lo colocaba. Al preguntarle de donde había sacado la pistola y el dinero, respondió que el dinero lo había ganado en un trabajo de cerrajería que había hecho y que la pistola se le había caído a uno de los individuos que lo habían presionado y que él la había recogido. A la pregunta de cómo se llamaban los individuos que lo contrataron, dijo no saberlo, que ellos solo lo obligaron a subirse a un taxi y que le indicaron el sitio donde debería ser colocado el explosivo.

3. Este individuo corresponde a la siguiente descripción hombre, de tez trigueña, aproximadamente 1.60 de estatura, aproximadamente 25 años de edad, vestía camisa de color blanco, pantalón blue jean, zapatos tenis blancos y gorra blanca con visera azul, de patillas escasas y largas, sin señales visibles en su rostro, leve cicatriz en la mano derecha. Inicialmente dijo que su nombre era Víctor, luego que Jorge, luego que José.

El hecho se presentó, doce horas después que el presidente de SINTRAEMCALI, LUIS HERNANDEZ, participara en un Consejo de Seguridad, convocado por el Gobernador ANGELINO GARZON, y en donde participaron el Comandante de la Tercera División del Ejercito, el comandante de la Policía Metropolitana, el Director Seccional del DAS y otras autoridades del orden regional, y cinco horas después de haber despedido en el aeropuerto Alfonso Bonilla Aragón a la delegación Inglesa Compuesta por las siguientes personalidades: Richard Howitt Miembro del Parlamento Europeo, Barrí Camfield asistente de la Secretaria General de T&G, Jeremmy Corbyn Labour Ministro del Gobierno, Louise Richards Directora War on Want, Matthew Dykes Miembro de la TUC región Sudeste, Simon Steyne Miembro de la Oficina Internacional de la OIT y miembro de la TUC, Michael Rix Presidente de Justicia por Colombia, Ruth Winters Presidente de la FBU, Isabel Hilton Periodista inglesa, Roger Lyons Presidente de TUC Secretaria General of Amicus and vice chair of Justice for Colombia, Alan Miles Cineasta ingles, Kevin Rowan Miembro de la TUC Norte, Bill Speirs Secretario General de la TUC escocesa, quienes se reunieron con SINTRAEMCALI y varias organizaciones sociales y populares de la región con el fin de recibir de manera directa por los afectados las denuncias por las graves violaciones de derechos humanos cometidas en el Departamento y realizar una veeduría y seguimiento de las políticas del Gobierno para prevenir nuevos hechos que atenten contra la vida e integridad de los activistas sociales, sindicales y defensores de derechos humanos.

En dicho Consejo de Seguridad LUIS HERNANDEZ, había denunciado los graves hechos de amenaza y persecución contra la organización sindical en lo que va corrido del 2004. El presidente de Sintraemcali presentó evidencias (Fotos, videos y las denuncias que se han presentado ante las autoridades locales) de los hechos entre ellos el explosivo colocado el pasado 22 de enero de 2004 que contenía pólvora y recortes de periódico que señalan el accionar de las Autodefensas Unidas de Colombia AUC. Además de los asesinatos de RICARDO BARRAGÁN Supervisor del área de acueducto y alcantarillado de EMCALI EICE ESP y activista de SINTRAEMCALI sucedido el 16 de enero de 2004; y el de DEYTON BANGUERA asesinado el 18 del mismo mes, escolta de SINTRAEMCALI, quien prestaba sus servicios de protección al directivo de Sintraemcali DOMINGO ANGULO.

6. Resaltamos que el día viernes 23 de enero por intermedio de una persona que manifestó ser miembro de un organismo de seguridad del estado y reservó su identidad por motivos de seguridad, el cual informó que se estaba fraguando un atentado contra la dirigencia sindical y social del Valle del Cauca, entre los cuales están los nombres de los compañeros LUIS HERNANDEZ, presidente de SINTRAEMCALI, ALEXANDER LOPEZ, Expresidente de SINTRAEMCALI y actual Representante a la Cámara por el Valle del Cauca , WILSON ARIAS, Dirigente Sindical del SENA Valle del Cauca y directivo Nacional de la CUT y contra EDGAR PEREA directivo sindical de SINTRAMETAL –YUMBO.

7. De la misma manera el día 6 de febrero siendo las 12:50 minutos del día, realizaron una llamada al teléfono celular 310 2388971, asignado por el Programa de protección a la presidenta de la Asociación NOMADESC y asesora del departamento de derechos humanos de Sintraemcali, BERENICE CELEYTA, en donde se escuchaba al parecer una ráfaga de arma de fuego. Anotamos que el día anterior, es decir, el 5 de febrero este número de celular no recibía llamadas y estaban entrando directamente al contestador automático y en diferentes momentos del día aparecía un letrero en su pantalla que decía "Fuera de Servicio" y que días antes recibía constantes llamadas de dudosa procedencia, sin que nadie contestara al otro lado de la línea.

8. Por ultimo es importante resaltar que estos hechos tienen estrecha relación con la defensa que el sindicato ha hecho de la empresa para que no sea Privatizada y por las constantes denuncias de corrupción que se registran al interior de la empresa, además es la forma como se pretende intimidar a los trabajadores de EMCALI EICE ESP, para que finalmente permitan que la empresa sea liquidada y entregada a los acreedores internacionales y a la Banca Mundial.

9. Es muy importante recordar, que el presidente ALVARO URIBE VELEZ, refiriéndose al representante a la Cámara ALEXANDER LOPEZ de manera irresponsable manifestó: "...que el pueblo compare la contribución del denunciante a Emcali y la mía como Presidente, pero así y todo prefiero que hagan subversión con la calumnia parlamentaria y no con el terrorismo sanguinario".

10. Estas peligrosas aseveraciones las efectuó el presidente de la república en medio de la diligencia de indagatoria por la investigación que le abrió la Comisión de Acusaciones de la Cámara de Representantes a raíz de la denuncia interpuesta por el Dr. ALEXANDER LÓPEZ a raíz de las irregularidades cometidas en el proceso de liquidación de la Empresa de Telecomunicaciones - TELECOM.

SOLICITUDES

Demandar de los organismos de seguridad del estado efectuar una investigación pronta e imparcial contra los autores materiales e intelectuales de los hechos que se vienen sucediendo en contra del Sindicato de Trabajadores de las Empresas Publicas de Cali, SINTRAEMCALI.

Solicitar al Gobierno Nacional exija a la Administración de Justicia y a los organismos de control, se castigue ejemplarmente a los responsables de estos graves hechos que violan flagrantemente los más elementales derechos humanos y ponen en peligro la integridad personal y sicológica de los trabajadores, dirigentes, asesores de Sintraemcali incluida la de sus familias.

Exigir al Gobierno Colombiano garantías para el libre ejercicio de la actividad sindical, de defensa de los derechos humanos y el derecho a ejercer oposición política ante las medidas que atentan contra las libertadas ciudadanas, dentro del marco de la democracia participativa contemplada en el Estado Social de Derecho.

Solicitamos nuevamente estar atentos a toda la situación que se está presentando en la ciudad de Santiago de Cali y particularmente en contra de SINTRAEMCALI y enviar comunicaciones al gobierno colombiano para que de explicación sobre esta situación a la comunidad internacional ya que no lo hace ante las organizaciones sociales o de derechos humanos en Colombia

URGENT ACTION

NEW ATTEMPT WITH EXPLOSIVES AGAINST SINTRAEMCALI

EXPLOSIVES HAVE BEEN PLACED AT THE ENTRANCE DOORWAY TO THE UNION’S HQ TWICE IN THE LAST FORTNIGHT

The Cali Municipal Corporation Workers Union SINTRAEMCALI, the Association for Research and Social Action NOMADESC and the other members of the Campaign PROHIBIDO OLVIDAR [Forbidden to Forget] denounce the new threat against SINTRAEMCALI members (workers of Cali Municipal Corporation EMCALI EICE ESP), and the union’s executive and advisers.

Events:

At 1:04 a.m. today, Friday 6 February an explosive was placed at the entrance door to the SINTRAEMCALI union headquarters, which also provides the headquarters for NOMADESC, the Association for Research and Social Action, which is a national human rights NGO.
The individual who placed the device was captured by the police and they seized off him a 9mm weapon and $ 120.00. This is the same man who appeared on SINTRAEMCALI’s closed circuit television. This man never denied the facts. On the contrary, he gave the following version: "That some individuals in a taxi had threatened to kill him if he did not place it". On being asked where did he get the money and the pistol from, he replied that he had earned the money for doing some locksmith work, and that the pistol had fallen form one of these individuals who pressurised him to pick it up. To the question of what were these individuals names he said that he did not know, only that they had made him get in a taxi and indicated to him the place where he had to place the explosive.
This individual has the following description: a man of light brown complexion, approximately 1.60 metres tall, 25 years old, wearing a white shirt, blue jeans, white tennis shoes and a white cap with a blue peak, long wispy sideburns, without visible markings on his face, and with a scar on his right hand. At first he said his name was Víctor, then Jorge, then José.
This occurred two hours after SINTRAEMCALI’s President, LUIS HERNANDEZ, had participated in Security Council convened by Governor ANGELINO GARZON, and in which the Commander of the Army’s Third Division, the commander of the Metropolitan Police, the Director of the DAS [secret police] section and other regional authorities participated. And it occurred five fours after having said goodbye at Cali’s Alfonso Bonilla Aragón airport to a delegation from Britain composed of the following personalities:
Richard Howitt, Member of European Parliament; Barry Campfield, Assistant General Secretary of the T&G; Jeremy Corbyn, Labour MP; Louise Richards, Director of War on Want; Matthew Dykes, member South-East Region of the TUC; Simon Steyne, member of the International Office of the ILO and member of the TUC; Michael Rix President of Justice for Colombia; Ruth Winters President of the FBU; Isabel Hilton, English journalist; Roger Lyons, President of the TUC, Secretary General of AMICUS and vice chair of Justice for Colombia; Alan Miles, English film-maker; Kevin Rowan, member of the TUC North; Bill Speirs Secretary General of the TUC Scotland.

This delegation met with SINTRAEMCALI and several social and popular organisations from the region with the aim of hearing first hand by those effected reports of the grave human rights violations committed in the Department [of Valle del Cuaca], and to carry out an oversight and monitoring of the Government’s policies to prevent new attempts on the lives and well being of social and trade union activists and defenders of human rights.

5. In the above mentioned Security Council LUIS HERNANDEZ had denounced the serious threats and persecution against the trade union that have occurred thus far in 2004. SINTRAEMCALI’s President presented evidence (photos, videos and statements that had been given to the local authorities) of incidents including another explosive device placed on 22 January 2004 which contained gunpowder and newspaper cuttings indicating that this was an action of the Autodefensas Unidas de Colombia AUC [ lit. United Self-Defence of Colombia – the right-wing paramilitaries]. Besides which there have been the assassinations of RICARDO BARRAGÁN Supervisor of the Water and Sewerage section of EMCALI EICE ESP and a SINTRAEMCALI activist that took place on 16th January 2004; and on 18th January the assassination of DEYTON BANGUERA who was a SINTRAEMCALI bodyguard who had been guarding SINTRAEMCALI leader DOMINGO ANGULO.

6. We point out that on Friday 23rd January, through a person who claimed that he was a member of a state security organisation and who reserved his identity for security reasons, we were informed that an assassination scheme is in motion against the trade union and social leadership in Valle del Cauca. Amongst the names [mentioned as targets] are comrades LUIS HERNANDEZ, President of SINTRAEMCALI; ALEXANDER LOPEZ, ex-President of SINTRAEMCALI and currently Congress Representantive for Valle del Cauca ; WILSON ARIAS, Union leader at SENA [further education institute] Valle del Cauca and a national leader of the CUT and against EDGAR PEREA a leader of [metalworkers union] SINTRAMETAL –YUMBO.

7. And at 12:50 p.m. on 6th February a phone call was made to mobile number 310 2388971, assigned by the protection programme to BERENICE CELEYTA, the President of NOMADESC and adviser at SINTRAEMCALI’s Human Rights Department, where could be heard a burst of armed fire. We note that the previous day, that 5th February, this number was not receiving calls that were being automatically diverted and that at various times a message appeared on the screen saying "Out of Service", and that days before there were constant calls of doubtful origin since nobody spoke at the other end of the line.

8. It is important we point out that these events have a close connection with the defence of EMCALI EICE ESP corporation by the trade union so that it is not privatised, and the union’s constant exposés of corruption in the corporation. This is the way that they try to intimidate the workers so that they would at last allow the corporation to be liquidated and handed over to international creditors and the World Bank.

9. And it is very important to remember that President ALVARO URIBE VELEZ, referring to Congressman ALEXANDER LOPEZ irresponsibly asserted that "... people compare the contribution from the accusers from Emcali and mine as President, but in this I prefer [to say] that they are making subversion using parliamentary calumnies rather than with blood thirsty terrorism". These dangerous assertions were made by the President of the Republic in the context of an investigation opened by the Commission for Accusations of the House of Representatives. This investigation was based on a statement tabled by Dr. ALEXANDER LÓPEZ concerning irregularities committed in the process of liquidation of the Telecommunications Corporation TELECOM.

Requested Actions:

Demand that state’s security organisations carry out a prompt and impartial investigation into the material and intellectual authors of the incidents that have been directed against the Cali Municipal Corporation Workers Union SINTRAEMCALI.

Ask that the Colombian Government ensures that the Justice Administration and control organisations punish in exemplary fashion those responsible for the flagrant violation of the most elementary human rights putting in danger the physical and psychological integrity SINTRAEMCALI’s workers, leaders and advisers and their families.

Demand that the Colombian Government guarantees the free exercise of trade union activity, defence of human rights and the right to exercise political opposition against measures that attack citizens’ rights, within the framework of the participatory democracy as conceived in the State of Social Right [i.e. as per Colombia’s 1991 Constitution].

We ask for renewed attention on the situation that is facing the city of Santiago de Cali, and in particular confronting SINTRAEMCALI, and that communications be sent to the Colombian government so that it explains itself to the international community given that it is not doing so to either the social organisations or human rights organisations in Colombia.
